New Hampshire Judge Issues Injunction on PFAS Drinking Water Regulations

On November 26, 2019, a New Hampshire judge issued a preliminary injunction to halt the implementation of the state’s new drinking water regulations for four PFAS compounds (PFOA, PFOS, PFHxS and PFNA). This action came from a lawsuit against the state by 3M, the Plymouth Village Water and Sewer District, a farmer, and Resource Management, Inc. (a biosolids company). The lawsuit alleges that New Hampshire did not conduct adequate cost-benefit analysis and did not get public input on lowering the MCLs from the originally proposed levels. Until the injunction takes effect on December 31, 2019, the state is continuing to implement the new PFAS regulations that were adopted on October 1st and can pursue reconsideration and/or an appeal before the injunction takes effect.
