EPA Declares Date for Proposed Lead and Copper Rule Improvements

EPA is being sued by several parties (not really unusual for significant drinking water regulations), including NRDC and Earthjustice, on the Lead and Copper Rule Revisions (LCRR) that were finalized on January 15, 2021 (86 FR 4198). NRDC and Earthjustice recently reported that EPA’s Assistant Administrator for Water, Radhika Fox, stated in a declaration in response to this lawsuit that the Agency intends to propose revisions to the LCRR (through the Lead and Copper Rule Improvements [LCRI]) by September 2023 and publish the final LCRI no later than October 16, 2024, the deadline for the initial lead service line inventories. The declaration (below) provides some interesting information about the evolution of the LCRR and LCRI over the past two years, such as the stakeholder outreach and outside reviews.
