EPA Announces Proposed Clean Water Act Rule for Section 401 Federal Permits and Licenses

EPA has announced its proposed, “Clean Water Act Section 401 Water Quality Certification Improvement Rule,” to update the regulatory requirements for water quality certification under Clean Water Act (CWA) Section 401. This proposed rule would strengthen the authority of states, territories, and tribes to protect the quality of their waters (including drinking water sources) from potential impacts resulting from federally licensed or permitted project discharges into waters of the United States. The Agency is taking comment on this proposed rule for 60 days beginning on the date it is published in the Federal Register.
